Scope of application

The Ordinance lays down rules on the restriction of the use of hazardous substances in electrical and electronic equipment (EEE) with a view to contributing to the protection of human health and the environment, including the environmentally sound recovery and disposal of waste EEE.

 

Main requirements that business users should know

Article 4 of the Ordinance stipulates the requirements for placing on the market – EEE, cables, and spare parts for the repair, reuse, updating of the functionalities or upgrading the capacity placed on the market by economic entities in the Republic of Croatia; in homogenous materials these products may not contain substances specified in Annex II of the Ordinance exceeding the maximum concentration values laid down in the Annex II.

Article 12 of the Ordinance stipulates rules regarding the EU declaration of conformity. The EU declaration of conformity has to have the model structure specified in Annex VI of the Ordinance, and it has to contain all the elements referred to in the Annex VI, which have to be updated after any amendment that may affect conformity of the EEE with the requirements stipulated in the Ordinance. The EU Declaration of Conformity has to be made in Croatian language or translated to Croatian language, if it refers to the EEE placed on the market in the Republic of Croatia, i.e. made or translated into the language or languages required by the Member State on the market of which the EEE is placed or made available.

Furthermore, Articles 6-9 of the Ordinance stipulate obligations of economic operators that are under obligation to place on the market the EEE designed and produced in accordance with demands regulated by the Ordinance.
